Employers that are subject to New York’s disability benefit law are also subject to paid family leave law. The deduction is based on a percentage of the employee’s salary up to a maximum of New York State’s average weekly wage. This average weekly wage is recalculated annually by the state Department of Labor.
Generally, the employer secures paid family leave insurance and the premiums are funded by the deductions from the employee’s wages.
